Subject outline
This subject explores and analyses Australia's disability law and policy, and aims to support those looking to pursue a legal or policy career in state or federal government, the disability sector or human rights lawyering. The first part of the subject establishes the theoretical and legal framework based on human rights principles within the United Nations Convention on the Rights of Persons with Disabilities. The framework is then tested by an examination of particular case studies, which may vary from year to year. Generally, important practice contexts such as the National Disability Insurance Scheme, discrimination law, supported decision making: inclusive education or the interactions of disability and the criminal justice system will be taught in depth. Throughout the study period the role of law and policy in promoting and protecting the rights of people with disabilities is evaluated: areas requiring reform are identified; and strategies for the change considered.
